The short version

• Pesso is software, not a bank. Your wallet and the money in it are yours. We never hold, move, freeze or recover your funds, and we never see your key.
• Payments on the blockchain are final. No one, including Pesso, can reverse one.
• Other companies provide parts of Pesso, such as buying digital dollars, under their own terms.
• Pesso adds no fee today. Network fees and providers’ fees are shown before you confirm.
• Nothing in Pesso is advice. Digital assets carry risk, and you decide what to do with yours.

1. These terms

These terms apply when you use Pesso at pesso.xyz, in the Pesso app, or through Pesso’s API. By using Pesso you agree to them, and to our privacy policy. If you don’t agree, please don’t use Pesso.

To use Pesso you must:

• be 18 or older and able to enter into a contract;
• not be a person named on a sanctions list, or owned or controlled by one, and not be in a country or region subject to comprehensive sanctions;
• not be prohibited by the law where you live from using a service like Pesso.

2. What Pesso is

Pesso is self-custodial wallet software. When you sign in, Pesso creates a wallet on the Base network: a smart account that only your key can operate. Your key is created and protected by our sign-in provider, Privy, and only you can use it. Pesso cannot sign for you or move your money.

Pesso is not a bank, an exchange, a broker or a custodian, and it does not issue electronic money. Money in your wallet is not a bank deposit and is not covered by any deposit or investor compensation scheme.

The digital dollars Pesso shows are USDC, issued by Circle, not by Pesso. Their value depends on their issuer and the network they run on.

3. Your wallet and your key

• You are responsible for keeping your sign-in, passkey and authenticator app secure, and for everything done with them.
• You can export your key from the Receive screen on pesso.xyz. If you lose access to your sign-in and have not exported your key, we cannot restore your wallet.
• Check every address and amount before you confirm. Money sent to a wrong address cannot be recovered.

4. Services from other companies

Parts of Pesso are provided by other companies, each under its own terms. Pesso does not control them and is not responsible for what they do.

• Buying digital dollars. When you add money, you buy from a payment provider: Coinbase (terms) or, where Pesso offers it, Transak (terms). You contract with that provider, it verifies your identity and decides your limits, and disputes and refunds are for it to resolve. You will be asked to accept its terms before you buy.
• Sign-in and your key: Privy.
• Network fees and transaction delivery: Candide.
• Trades: trading venues such as KyberSwap and 0x.
• Apps you connect with WalletConnect. Pesso does not review, list or endorse them. What you approve in a connected app is between you and that app.

5. Fees

Pesso adds no fee for the wallet, sending, receiving, adding money or trading. Every transaction pays a small network fee, which Pesso takes in digital dollars from your wallet and shows before you confirm. Payment providers and trading venues may charge their own fees, which are shown before you pay. If Pesso ever charges a fee, we will show it before you confirm and update these terms first.

6. Risks

• Digital dollars aim to stay at one US dollar but can lose that value. Other tokens can rise or fall sharply, become impossible to sell, or fall to nothing.
• Blockchains and smart contracts can fail, be attacked or be congested, and transactions can be delayed.
• Nothing in Pesso is financial, investment, tax or legal advice. Information about a token, including its price and any facts shown about it, can be wrong or out of date.
• You are responsible for any tax on what you do with your digital assets.

7. Payment requests, API keys and webhooks

You are responsible for the payment request links you create and share, and for how you use Pesso’s API. Keep your API keys secret. We may revoke a key or deactivate a link that is used to break these terms.

8. Acceptable use

You must not use Pesso to:

• break any law, or launder money, finance terrorism or evade sanctions;
• defraud, scam or deceive anyone, or pay for illegal goods or services;
• use someone else’s account or key without their permission;
• interfere with, overload, probe or copy Pesso or its providers’ systems.

We may refuse an action, or stop providing Pesso’s services to you, if we reasonably believe you are breaking these terms, to comply with the law or sanctions, or to protect Pesso or other users. This never touches your funds: your wallet stays yours, and you can use your key with any compatible wallet.

9. Changes to Pesso

Pesso is provided as it is and as available. We may change, pause or stop features. If we stop Pesso, your wallet and money stay on the blockchain, and you can reach them with your exported key.

10. Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit, and nothing affects your legal rights as a consumer.

Otherwise, we are not responsible for losses caused by: blockchains, smart contracts or tokens; the services of other companies; your sign-in, key or devices; addresses or amounts you confirmed; or changes in the value of digital assets. We are not responsible for losses we could not reasonably have foreseen. Our total liability to you is limited to £100.

11. Ending

You can stop using Pesso at any time, and delete your account as the privacy policy explains. We may end these terms by telling you, or straight away if you seriously break them. Sections 6 and 10 continue after these terms end.

12. Changes to these terms

If we change these terms we’ll update the date above and, for significant changes, tell you in the app before they apply. If you keep using Pesso after that, the new terms apply.

13. Law and disputes

These terms are governed by the law of England and Wales, and its courts can hear any dispute. If you live elsewhere as a consumer, you keep the protection of the mandatory laws where you live, and you can also bring a claim in your local courts.
